The Supreme Court has in a unanimous decision dismissed the suit filed by New Patriotic Party (NPP) Member of Parliament (MP) for New Juabeng South, Dr. Mark Assibey Yeboah in which government had been challenged for purchasing a 250MW Karpower ship from a Turkish company without seeking parliamentary approval.
The Karpowership was one of the solutions sought by government to solve the power generation shortfall that resulted in load shedding for years.
The MP who was represented by his MP for Effutu, Alexander Afenyo-Markin, prayed the court to determine the authority of government in the purchase of the plant.
Lawyer Afenyo-Markin, prior to the suit, had raised an issue on the floor of the house, in respect of Article 181 (Clause 5) of the 1992 constitution, which states that every international financial agreement by government must be brought to parliament for approval.
However, the Supreme Court presided over by Justice Jones Dotse has on Thursday July 28, 2016 dismissed the case.
