Kumasi High Court dismisses injunction on Daddy Lumba’s funeral – widowhood question remains unresolved

On October 28, 2025, the Kumasi High Court dismissed an application seeking to halt funeral and burial arrangements for the late Highlife legend Charles Kwadwo Fosuh, popularly known as Daddy Lumba.

According to GhanaSky.com reporters, the decision removes the immediate legal barrier to the family proceeding with planned rites, but the court has not ruled on who is the late musician’s lawful widow. A substantive suit seeking a declaration of widowhood is still active and awaiting a final judgment.

What the court decided

On October 28, 2025, the Kumasi High Court struck out the injunction application filed by Akosua Serwaa, who had sought to halt access to Daddy Lumba’s body and to pause funeral arrangements. The ruling is procedural it only deals with whether the funeral should be frozen immediately.

The court’s decision means there is no injunction preventing the family from accessing the body or continuing with the funeral plans. However, the underlying case asking for a declaration of lawful widowhood remains active before the court.

Has the court named an official widow?

No. The court’s action on October 28 related only to the injunction. It did not issue a final judgment on marital status or widowhood rights.

Although reports and statements from the family and other parties have circulated — including one suggesting a German Embassy confirmation of a marriage between Daddy Lumba and Akosua Serwaa, these are not the same as a court judgment.

Only the Kumasi High Court can issue a legally binding ruling under Ghanaian law, and as of now, no such declaration has been made.

This means that, at the time of this update, the question of who the court recognises as the lawful widow of the late Daddy Lumba remains unresolved.
